1. Introduction [1]

These Terms of Service (the "Terms") govern your access to and use of the caller ID, spam scoring, and related data services provided by AccuNums ("AccuNums", "we", "our", or "us") through our website AccuNums.com, APIs, web tools, mobile or desktop interfaces, and any other products or services we make available (collectively, the "Services").

The Services are intended primarily for use by businesses, organizations, and professionals. By using the Services, you represent that you are acting for purposes relating to your trade, business, craft, or profession and not as a consumer, to the maximum extent permitted by applicable law.

Your use of the Services is conditioned on your acceptance of and compliance with these Terms. If you are using the Services on behalf of an organization, you are agreeing to these Terms on behalf of that organization and you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Services.

While we strive to provide accurate and timely information, we do not guarantee that any caller ID, spam score, or related information is complete, correct, or up to date.

5. Acceptable Use and Prohibited Activities [5]

You agree to use the Services only for purposes that are lawful and permitted by these Terms. You shall not, and shall not permit any third party to:

  1. Violation of Law: Use the Services for any unlawful, harmful, fraudulent, or malicious purpose, including in violation of any local, national, or international laws, regulations, or industry rules.
  2. Unlawful Telemarketing or Spam: Use the Services to:
    • Facilitate or engage in unlawful robocalls or unsolicited communications.
    • Bypass or ignore consent requirements, do-not-call regulations, or other consumer protections.
    • Build or enhance lists that will be used solely or primarily for unsolicited contact.
  3. Abuse of Data: Use the data from the Services to harass, stalk, intimidate, discriminate, or otherwise harm individuals or entities.
  4. Reverse Engineering: Decompile, disassemble, or reverse engineer any part of the Services, or derive any source code or underlying algorithms except to the limited extent permitted by applicable law.
  5. Excessive Load: Interfere with or disrupt the integrity or performance of the Services, including by imposing an unreasonable or disproportionately large load on our infrastructure.
  6. Resale Without Permission: Resell, sublicense, lease, distribute, or otherwise make the Services available to third parties except as expressly allowed in a written agreement with AccuNums.
  7. Misrepresentation: Represent any output from the Services as being absolute fact without appropriate disclaimers, or misrepresent your relationship with AccuNums.

6. Caller ID and Spam Score Specific Terms [6]

The caller ID and spam score information provided by AccuNums is inherently probabilistic in nature. You acknowledge and agree that:

To the fullest extent permitted by law, AccuNums is not liable for any damages or losses arising from your reliance on any caller ID, spam score, or related information obtained through the Services.

10. Refunds, Cancellations, and Chargebacks [10]

10.1 General Rule – Non-Refundable Fees

Except as expressly provided in this Section 10 or required by applicable law, all fees, purchases of credits, subscription charges, and other payments made to AccuNums are final and non-refundable. This includes, without limitation:

Credits and usage balances are a license to access and use the Services and do not constitute money, electronic money, or stored value.

For subscription Services, cancellation stops future renewals. Except where required by applicable law (including the consumer cancellation rights described in Section 10.6), we do not provide refunds for unused portions of an already-started billing period; there are no refunds on unused subscription periods.

If you pre-order a Product or feature that is not yet available, you may cancel the pre-order and request a refund for any reason until the Product is first delivered or made available to you. After delivery, the standard rules in this Section 10 (including any applicable consumer rights) apply to that purchase.

10.2 Discretionary Refunds and Service Credits

Outside of the specific 14-day consumer cancellation rights described in Section 10.6 and any other non-waivable statutory rights you may have, refunds are provided at our sole discretion, on a case-by-case basis, and may be refused. We may refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behaviour that entitles us to counterclaim the refund.

If we experience a documented, material, and attributable service error or outage that prevents you from using the Services in accordance with these Terms, we may, at our discretion and as your sole and exclusive contractual remedy:

You agree to first contact AccuNums to attempt to resolve any billing or payment issue before initiating a chargeback or payment dispute with your bank or payment provider.

10.6 Consumer 14-Day Cancellation Right and Mandatory Rights

To the extent you are classified as a consumer under the laws of your jurisdiction (a "Consumer"), you may have additional mandatory statutory rights that cannot be limited by these Terms. This Section 10.6 describes how we apply a 14-day cancellation right for Consumers, in addition to any other non-waivable rights you may have (for example, where a Product is faulty, not as described, or not fit for purpose).

14-day cancellation period. If you are a Consumer and no exception applies (see below), you have the right to cancel your contract for a Product purchased through the Services and request a refund within fourteen (14) days without giving any reason. The cancellation period ends fourteen (14) days after the day following completion of the relevant transaction.

To meet this deadline, it is sufficient that you send us a clear statement of your decision to cancel before the 14-day period expires. You can exercise this right by emailing us at [email protected] with enough information for us to identify your order (such as your name, email address used for purchase, order reference, and the Product you wish to cancel). You may also cancel by sending us any other clear, unambiguous statement through our available communication channels. If you contact us through an online form that we make available for this purpose, we will acknowledge receipt of your cancellation request without undue delay.

Subscriptions. For subscription Services, this 14-day Consumer cancellation right applies only to the initial subscription purchase. It does not apply to subsequent automatic renewals of the same subscription, except where such rights are mandatory under applicable law.
